The Clean Air Framework Under Attack

In the 1970s, CLIPI brought the nation's first Clean Air Act cases. Mary Nichols, CLIPI's first legal hire, filed the suits that forced Southern California to begin the decades-long process of cleaning up its air.
That legal framework helped make California's air 1,000 times cleaner than it was in the 1960s.
This July, the EPA sent two of California's Clean Air Act waivers to Congress, seeking to overturn them through the Congressional Review Act. In February, the agency rescinded the greenhouse gas endangerment finding entirely, eliminating the legal basis for regulating vehicle emissions under the Clean Air Act.
The EPA called it the largest deregulatory action in U.S. history.
California has sued. The legal battle over these waivers will likely define the future of state-level environmental regulation in this country.
Fifty years ago, CLIPI established the principle that clean air is a legal right, not a political preference. The tools we built, the cases we won, and the legal frameworks we helped create are now being challenged at a fundamental level.
The work of public interest law is never finished. It has to be defended by each generation.
